Throughout this policy, references to "RevGem" shall refer to RevGem LLC.
By submitting items to RevGem, using our website, or accepting an offer from RevGem, you agree to the following Terms and Conditions.
1. Ownership and Authority
You represent and warrant that:
You are the lawful owner of all items submitted to RevGem, or have full legal authority to sell such items.
The submitted items are free of liens, claims, or ownership disputes.
All information provided to RevGem is accurate and complete.
RevGem reserves the right to request additional documentation to verify ownership.
2. Evaluation Process
RevGem evaluates gemstones, break out scrap, jewelry stones, melee, and related materials using industry-standard testing methods and professional judgment.
You acknowledge that:
Gemstone identification and valuation involve subjective opinions.
Estimates, descriptions, and valuations are not guarantees of market value.
RevGem may determine that submitted items have little or no resale value.
All offers are non-binding until accepted by both parties.
3. Synthetic, Treated, and Simulant Materials
Submitted parcels may contain synthetic, treated, assembled, imitation, or simulant materials.
RevGem reserves the right to:
Identify and value such materials according to their actual market value.
Adjust any offer based on testing results.
Decline to purchase any submitted material for any reason.
4. Offers and Payment
If you accept an offer:
Ownership of the accepted items transfers to RevGem upon issuance of payment.
Payment will be issued using an agreed-upon payment method.
All accepted transactions are final.
Once payment has been issued, items cannot be returned.
5. Declined Offers and Returns
If you decline an offer:
RevGem will return the submitted items to the address provided by you.
Returned shipments will be sent with insurance coverage determined by RevGem.
You are responsible for ensuring your return address is accurate.
RevGem is not responsible for loss, theft, damage, or delivery issues after the return shipment has been delivered according to carrier tracking records.
6. Shipping and Risk of Loss
RevGem may provide prepaid shipping labels or shipping instructions.
Risk of loss transfers as follows:
Items are covered only to the extent of available carrier insurance.
RevGem is not responsible for losses caused by carrier delays, carrier negligence, acts of nature, theft, or events beyond our control.
Customers are encouraged to photograph and document all items prior to shipment.
7. Limitation of Liability
To the fullest extent permitted by law, RevGem shall not be liable for:
Market value fluctuations.
Differences of opinion regarding gemstone identification or grading.
Losses exceeding available insurance coverage.
Consequential, incidental, indirect, or special damages.
Loss of profits, business opportunities, or speculative value.
RevGem's maximum liability shall not exceed the amount of available insurance coverage or the amount paid by RevGem for the items in question, whichever is less.
8. Right to Refuse Service
RevGem reserves the right to refuse, cancel, or terminate any transaction at any time and for any reason.
9. Governing Law
These Terms and Conditions shall be governed by and interpreted under the laws of the State of Indiana, without regard to conflict of law principles.
10. Changes to These Terms
RevGem may update these Terms and Conditions at any time. Continued use of our services constitutes acceptance of the updated Terms.
